Antwoord: De EU AI Act voorziet in straffen tot 7% van wereldwijde jaarlijkse omzet voor groet-risico schendingen (zoals het inzetten van niet-gecertificeerde hoog-risicosystemen) of €30 miljoen, naar gelang welke groter is. Schendingen van documentatieverplichtingen bereiken €20 miljoen of 4% van omzet. Schendingen van transparantieregels bereiken €10 miljoen of 3% van omzet. Deze progressieve strafschaal benadrukt dat handhaving ernstig zal zijn.

Vraag: Kan mijn bedrijf om uitstel verzoeken na augustus 2026?

Antwoord: Nee. De EU AI Office heeft duidelijk gemaakt dat de handhavingsfase definitief wordt geactiveerd op 2 augustus 2026. Nationale instanties zullen onmiddellijk markttoezicht beginnen. Nooduitstel is alleen beschikbaar voor zeer specifieke technische problemen met Notified Body-certificering, niet voor algemene onreadiness.

Vraag: Moet ik mijn bestaande AI-modellen volledig herscholen voor compliance?

Antwoord: Niet per se. Compliance draait om documentatie en governance, niet modelreprogrammering. Een bestaand model kan compliant zijn als u: (1) risicobewikkelingen voert, (2) trainings-/testdata documenteert, (3) bias-metriek establiseert, (4) monitoringprotocollen implementeert. In sommige gevallen moeten modellen worden afgesteld of nieuwe safeguards worden ingebouwd, maar totale herbouw is zelden nodig.
